Cosby defense rests as sexual assault trial nears its end

The defense team in Bill Cosby's sexual assault retrial rested its case on Monday as the comedian once again didn't take the stand in his own defense.

Cosby didn't testify a year ago (17) when the first trial took place, and after four days of defence witnesses, Mesereau made it clear his client would not be taking the stand to answer claims he drugged and raped Andrea Constand at his home in Philadelphia in 2004.

He didn't testify at his first trial, either. That one ended in a hung jury past year.

Closing arguments in the retrial at the Montgomery County Courthouse in Norristown will be held on Tuesday morning (24Apr18) and the members of the jury will begin deliberations. He says it was consensual. And they have heard from a witness who says his chief accuser talked about framing a high-profile person to score a big payday.

The defense had hoped that Sheri Williams would be a key witness for their allegation that Cosby accuser Andrea Constand was setting the comedian up with her accusations against him.

Prosecutors are highlighting gaps in Bill Cosby's travel records.

Cosby's lawyers devoted the last two days of their case to travel records they say prove he couldn't have been at his suburban Philadelphia home in January 2004.

But prosecutors pointed out multiple stretches of time that month when Cosby wasn't aboard his private jet or performing around the country. And District Attorney Kevin Steele noted in court Monday that the records reflect only jet travel, not other modes of transportation.

Jurors also heard Monday from Roslyn Yarbrough, a former secretary for Cosby's agent, who testified that Cosby spent most of his time at his MA estate and New York City townhouse and was "very rarely" at the home near Philadelphia.

The judge in Bill Cosby's sexual assault retrial won't allow his lawyers to introduce testimony they say would shed light on the possible motivation of the comedian's chief accuser. The defense wanted to use the testimony from Andrea Constand's 2005 civil lawsuit against Cosby after failing to reach Williams with a subpoena, but O'Neill rejected the request, saying a prosecutor should have the right to cross-examine her.

Cosby has said he gave Constand 1½ tablets of the over-the-counter cold and allergy medicine Benadryl to help her relax before what he called a consensual sexual encounter. The defense portrays Cosby as a victim of Constand, who, they say, was pursuing him for money.

Cosby was charged for the drugging and assault of Constand at the end of December 2015, so if the encounter had happened earlier than January 2004, he could not be prosecuted under Pennsylvania law.

The Associated Press doesn't typically identify people who say they're victims of sexual assault unless they grant permission, which Constand has done.
