India rejects United Nations report on human rights violation in Kashmir as fallacious

The UN human rights office report highlights'chronic impunity for violations committed by security forces

India earlier on Thursday called the report misleading and mischievous, adding it "violates its sovereignty and creates a false narrative".

The government strongly rebutted the charges, with the MEA questioning "the intent in bringing out such a report".

There is an urgent need to address past and ongoing human rights violations and abuses and deliver justice for all people in Kashmir, who for seven decades have suffered a conflict that has claimed or ruined numerous lives, a report by the UN Human Rights Office published on Thursday says. After the two armies agreed on May 30 to stop exchanging artillery fire following the repeated deadly clashes, thousands of people from Jammu and Kashmir headed back to their homes near the de facto border with Pakistan.

"It is disturbing that those behind this report have chosen to describe internationally designated and UN-proscribed terrorist entities as "armed groups" and terrorists as "leaders".

The UN "Report on the Situation of Human Rights in Kashmir: Developments in the Indian State of J-K from June 2016 to April 2018, and General Human Rights Concerns in Azad J-K and Gilgit-Baltistan" also noted since the late 1980s, "a variety of armed groups has been actively operating in the Indian state of J-K".

"Our protest and views in the matter have been conveyed unequivocally to the Office of the High Commissioner for Human Rights".

"India rejects the report".

UN high commissioner for human rights Zeid Ra'ad Al Hussein further urged the UN Human Rights Council to establish a commission inquiry to conduct a "comprehensive, independent global investigation into allegations of human rights violations in Kashmir".

Pointing out that "terrorism is the most egregious violation of human rights", Kumar said that the United Nations report "conveniently ignored the pattern of cross-border terrorism emanating from Pakistan and territories under its illegal control".

India reiterated that it does not recognise the geographical territories as defined in the report.

The report's main focus is on IHK, the FO noted, and the "contents, scale and the narrative of killings, maiming, abuse and impunity articulated in the report is a reaffirmation of what Pakistan has long highlighted for the worldwide community". Alleged sites of mass graves in the Kashmir Valley and Jammu region should be investigated, he said. It further called the report a selective compilation of largely unverified information. "Instead of seeking to alter the status of the occupied territories, Pakistan should immediately vacate all areas under its illegal occupation". "We feel that United Nations has drafted the report without visiting Jammu and Kashmir". Despite the Government of Pakistan's denial of any support for these groups, the report notes that a number of experts have concluded that Pakistan's military continues to support their operations across the Line of Control. "This undermines the UN-led consensus on zero-tolerance to terrorism", he said.

New Delhi also lodged a strong protest with the United Nations, saying the government was "deeply concerned that individual prejudices are being allowed to undermine the credibility of a UN institution".
