Net neutrality repeal takes effect Monday

Many ISPs say they are waiting to see what happens with the proposed Net Neutrality rules.

fccdotgov/FlickrToday, the Federal Communications Commission's (FCC) repeal of Obama-era "net neutrality" regulations goes into effect.

FCC Chairman Ajit Pai said last week the rollback will ensure more investment by providers and will ensure "better, faster, and cheaper Internet access and more broadband competition to the American people". But in December, the FCC switched broadband back to a Title I classification, giving the FTC some of the regulatory authority the FCC previously had over ISPs and negating the legal authority the FCC had to ban practices like blocking, throttling and paid prioritization. Some consumers fear a slower Internet and higher costs for broadband delivery.

Net neutrality means that Internet providers have to treat everyone equally online. The industry has largely promised not to block or throttle websites in the absence of the rules, and the repeal order is still facing a legal challenge from a coalition of net neutrality supporters. The rules also restricted ISPs from charging extra for certain traffic, creating so-called fast lanes for companies and consumers.

"In the House, we'll need 218 lawmakers to sign on to a "discharge petition" in order to force a vote past leadership to the floor", the coalition's website outlines.

"It's now as clear as day to every American that - with the exception of three Republicans in the Senate - their Republican representatives in the Congress chose to protect special interests and the biggest corporates over middle-class families, average consumers, entrepreneurs and anyone who relies on the free and open internet", Schumer said.

Proponents of net neutrality quickly mobilized for the overturn of the FCC's repeal, and last month, the U.S. Senate passed a bill that would scrap the FCC's decision and retain net neutrality rules. In 2015, the FCC approved a set of regulations on ISPs.

"At the dawn of the commercial Internet, President [Bill] Clinton and a Republican Congress agreed on a light-touch framework to regulating the Internet. The Internet is coming for net neutrality". Per the net neutrality order, states can not enact any legislation that attempts to circumvent the repeal. According to the National Council of State Legislatures, governors in six states - New Jersey, New York, Montana, Rhode Island, Vermont and Hawaii - have signed executive orders upholding net neutrality, and three - Washington, Vermont and OR - have enacted legislation that does so.
