NYC delivery man given emergency stay

Attorneys for Pablo Villavicencio, the delivery man detained by ICE while dropping off a pizza to Fort Hamilton in Bay Ridge last week, filed an emergency motion on Friday afternoon in an effort to halt the deportation of the husband and father of two.

"Although we are disappointed that Pablo will remained detained, today's stay is a victory for him and his family, and also for due process and the fair administration of justice", Gregory Copeland, supervising attorney of the Immigration Law Unit at The Legal Aid Society, said in the statement.

The Legal Aid Society was able to obtain the temporary stay for Villavicencio after a hearing in Manhattan court Saturday.

Pablo Villavicencio was detained when he made a delivery to Fort Hamilton army base on Friday and was asked for a second form of ID. "They're going to separate my daughters from him".

'They've got two little kids, so she'd have to struggle as a single mom, ' he told the New York Post.

"As a result of military police action at the Fort Hamilton Army Base, in accordance with the Department of Army Access Control standards for all visitors, an individual with a warrant was identified upon seeking entrance to the Fort", said Golden, a member of the Senate Committee on Veterans, Homeland Security and Military Affairs.
